Notice under The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012

On 16 December 2025 the County Council intends to hold a meeting of Cabinet where the following item will be considered: Local Government Reorganisation (LGR): East Sussex County Council's responses to Government's statutory consultation on proposals for a single tier of local government in the area of East Sussex.

 

The purpose of the item is:

Cabinet will consider East Sussex County Council’s response to government’s statutory consultation on proposals for a single tier of local government in the area of East Sussex.

 

Under the requirements of Regulation 9 of The Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2021, the Council is required to give 28 days’ notice of a key decision identified within the scope of these regulations.

 

It is considered that the item referred to above would be a key decision and for the reasons of urgency set out below, compliance is considered impracticable, and an exception to Regulation 9 is therefore sought under Regulation 10 of the above Regulations. It is considered impracticable to comply with the requirements of The Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2021 because:

 

It is not possible to delay this decision in order to meet the 28 days’ notice on the Forward Plan due to office closures around the Christmas period. If notice is given on 28 November then the earliest the decision could be taken would be 27 December which is a non-working day and within the office closure period (25 December to 1 January). If an agenda was then published upon the office reopening (2 January) a meeting of the Cabinet could not be held until 12 January 2026 due to the papers needing to be available 5 clear days ahead of the meeting. If a meeting of the Cabinet were to be convened in early January, then there would not be sufficient time for the call-in period to elapse so that the decision can be implemented before the deadline for submission. The deadline to respond to the consultation is 11 January therefore it is not possible to meet the 28 days’ notice for a Key Decision and the consultation response must be considered by Cabinet at its meeting on 16 December.

 

Accordingly, a copy of this notice shall be available pursuant to Regulation 5(6) for at least 5 clear days prior to 16 December 2025.
